“Corruption Risks in the Legal Practice of Arresting the Persons and Problems for the Improvement of the Legal Obstacles” Public Policy Monitoring and Improvement Project

Highlighting the anti-corruption reforms underway in the new socio-political situation in Armenia, the “Center for Social Technologies” NGO has developed this monitoring project on evidence based public policy and improvement as a crime prevention measure in the law enforcement practice during taking decision to chose determent of the delinquent person as a measure of restraint and to eliminate the legislative barriers supporting them.

Paragraph 5.1 of Appendix to the Government Program Approved by Government Decision N 581-A of 1 June, 2018, indicates “arbitrary application of legislative possibilities to restrict human freedom” as “one of the most important issue in the field of human rights.”

The same paragraph, states as a solution that: “The Government shall encourage the application of non-custodial restraint measures. In addition, it should be ruled out that a person detained in a penitentiary institution has no sleeping place provided for by law. The number of detainees and arrested must be in line with the conditions provided for by the legislation of the Republic of Armenia.”
